By using our Website or Services, you acknowledge that you have read and understood this Privacy Policy.

1. Information We Collect

We collect information in three ways: information you provide directly, information collected automatically, and information from third parties.

1.1 Information You Provide.

We collect information you provide when you:

  • Submit forms on our Website (including contact, audit request, and consultation forms);
  • Create an account with us or our SiteHub™ portal;
  • Purchase or sign up for Services;
  • Communicate with us by email, phone, chat, or other means;
  • Post comments or content on our blog or other interactive areas; or
  • Subscribe to our newsletter or marketing communications.

This information may include: name, email address, phone number, mailing address, business name, billing information, account credentials, project details, content you provide for hosting or development work, and any other information you choose to share.

1.2 Information Collected Automatically.

When you visit the Website or use our Services, we (and our service providers) may automatically collect:

  • Payment processors (e.g., Stripe) confirming payment status (we do not receive or store your full credit card number);
  • Domain registrars and hosting infrastructure providers (e.g., WPMU DEV) in the course of provisioning Services;

  • Social media platforms when you interact with our profiles or content.

1.4 Information Hosted on Behalf of Clients.

For clients using our Hosting Services, our servers may store data, files, and end-user information that the Client is responsible for. We process such data only as necessary to provide the Services and as instructed by the Client. The Client is the data controller (or equivalent) for end-user information stored on the Client’s hosted website, and the Client is responsible for the privacy practices of its own website.

2. How We Use Information

We use the information we collect to:

  • Provide, operate, and maintain the Website and Services;
  • Process transactions and send invoices, receipts, and renewal notices;
  • Communicate with you about your account, projects, support requests, service changes, and policy updates;
  • Respond to inquiries, requests, and comments;
  • Send marketing communications about our products and services (with your consent where required by law; you may opt out at any time);
  • Improve, personalize, and develop the Website and Services;
  • Monitor, prevent, detect, and respond to fraud, abuse, security incidents, and violations of our terms;

4.1 Service Providers.

With third-party vendors and contractors who perform services on our behalf, including payment processing (Stripe), hosting infrastructure (e.g., WPMU DEV), email delivery, analytics, customer support, and software development. These providers are contractually limited to using personal information as necessary to provide their services.

4.2 Domain Registrars.

When you register a domain through us, your registration information is shared with the registrar and, as required by ICANN, may be included in publicly accessible WHOIS databases (subject to applicable privacy options).

4.3 Business Transfers.

In connection with a merger, acquisition, sale of assets, financing, or similar transaction, where personal information may be transferred as part of the business assets.

4.4 Legal Requirements.

When required to comply with applicable law, court orders, subpoenas, or governmental requests, or to protect the rights, property, or safety of CKreative Digital, our clients, or others.

4.5 With Your Consent.

For any other purpose disclosed to you with your consent.

4.6 Aggregated or De-Identified Data.

We may share aggregated or de-identified data that cannot reasonably be used to identify you for any purpose.

5. International Data Transfers

Our Services are provided from the United States. If you are located outside the United States, your information will be transferred to and processed in the United States, which may not have the same data protection laws as your country. Where required by law, we use appropriate safeguards (such as Standard Contractual Clauses) for international transfers of personal information.

6. Cookies and Tracking Technologies

6.1 Types of Cookies.

We use the following categories of cookies and similar technologies:

  • Strictly necessary: required for the Website to function (e.g., session cookies, security tokens). These cannot be disabled.

We retain personal information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Specifically:

  • Account and billing information: for the duration of the client relationship plus seven (7) years for tax and accounting purposes;
  • Hosting and email content: for the duration of the Service plus thirty (30) days following termination, unless a longer retention is requested or required;
  • Marketing list information: until you unsubscribe or three (3) years of inactivity, whichever is sooner;
  • Website analytics: aggregated and de-identified data may be retained indefinitely; and
    Inquiry and support information: up to three (3) years from last contact.

When information is no longer needed, we will securely delete or anonymize it.

8. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security and encourage you to use strong, unique passwords and protect your account credentials.

9. Data Breach Notification

In the event of a data breach affecting your personal information, we will notify you and applicable regulators without undue delay and as required by applicable law (including the breach-notification laws of the State of Ohio, the GDPR, and the laws of any other jurisdiction whose residents are affected).

10. Your Privacy Rights

10.1 Rights for All Users.

Regardless of where you live, you may:

  • Request correction of inaccurate information;
  • Request deletion of your personal information (subject to legal exceptions);
  • Opt out of marketing communications (using the unsubscribe link in any marketing email); and
  • Update your account information through your client portal.

10.2 Additional Rights for EEA, UK, and Swiss Residents.

Under the GDPR and equivalent laws, you also have the right to:

  • Withdraw consent at any time without affecting the lawfulness of prior processing; and
  • Lodge a complaint with a data protection authority in your country.

10.3 Additional Rights for California Residents.

If you are a California resident, the California Consumer Privacy Act (as amended by the California Privacy Rights Act) gives you the following rights:

  • Right to know: what categories of personal information we collect, the sources, the purposes for collection, and to whom we disclose it;
  • Right to delete: personal information we have collected, subject to legal exceptions;
  • Right to correct: inaccurate personal information;
  • Right to opt out of sale or sharing: We do not sell or share personal information for cross-context behavioral advertising in the way those terms are defined under the CCPA. To the extent any of our advertising practices (e.g., Google Ads) constitute a “share,” you may opt out by contacting privacy@ckreativedigital.com or using available browser controls (including Global Privacy Control);
  • Right to limit use of sensitive personal information: We do not use or disclose sensitive personal information beyond the purposes permitted by the CCPA; and
  • Right to non-discrimination:

We do not knowingly collect personal information from California residents under the age of 16 for sale or sharing.

11. Children’s Privacy

The Website and Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us at privacy@ckreativedigital.com and we will delete it.
